Deze verordening is vastgesteld op 20 juni 2017. De verordening wordt ter kennis gebracht van c.q. bekrachtigd door de gemeenteraad op 29 juni 2017.
De verordening is vooraf ter toetsing aan de commissaris van de Koning gezonden en wordt naar aanleiding daarvan ook in het Engels gepubliceerd.
De verordening is ter kennis gebracht van de Commissaris van de Koning in de Provincie Zeeland op 22 juni 2017.
De verordening is ter kennis gebracht van de Officier van Justitie van het Arrondissementsparket Zeeland - West Brabant op 22 juni 2017.
De verordening is gepubliceerd in het elektronische gemeenteblad van de gemeente Schouwen-Duiveland op 23 juni 2017.

Regulation for the enforcement of public order and risk reduction pursuant to Article 176 Gemeentewet (Municipal Council) (Emergency Ordinance Concert at Sea 2017)
The mayor of the municipality of Schouwen-Duiveland,
Regarding to article 176 of the Gemeentewet,
Considering,
that on Friday June 30th and Saturday July 1st 2017 the event Concert at Sea will take place;
that the event will be held at the Brouwersdam;
it is expected that 42500 visitors will be present during the event simultaneously;
that there will be a helicopter flying above and over the terrain to make image recordings;
that, considering the gathering of a vast number of visitors, and the above-mentioned flight movements, appropriate safety measures are necessary;
The existing legislation does not provide sufficient legal basis for taking the required temporary safety measures.
The following interests are served with this measure:
A. The personal safety of the those present at the festival site;
B. The safety of the helicopter flying above and over the festival site;
C. The prevention of possible disturbances
DECREE:
To establish the following general binding rules for the enforcement of public order and risk reduction:
Emergency Regulation prohibits the holding and / or possession of drones.
Article 1 Definitions
For the purposes of this Regulation:
A. Map: the authenticated map of the designated area as annexed to this Regulation (Annex 1);
B. Drone: a flying or otherwise moving or advanced and / or hanging or floating aircraft, whether or not equipped with a camera, without a pilot on board.
Article 2 Scope
This Regulation applies to the part of the territory of the municipality of Schouwen-Duiveland, as indicated in Annex 1 to this Regulation, on the authenticated map of the designated area as such.
Article 3 Prohibition of drones and similar aircrafts and parts thereof
1. It is in anyway prohibited to hold or possess a drone, similar aircraft and / or parts of a drone on Friday 30 June from 06:00 until Sunday 2 July 2006 at the public area, within the area designated in Annex 1.
2. The prohibition contained in paragraph 1 shall not apply to the organization of Concert at Sea and the police and other public services charged with the security of the visitors to the event.
Article 4 Police instructions
All instructions given by the police in compliance with the provisions of this Regulation or in the interests of public policy or security must be followed promptly.
Article 5 Monitoring of compliance
The following persons are responsible for supervising compliance with the provisions of this Regulation:
A. Police officers as referred to in Article 141 (b) of the Wetboek van Strafvordering (Code of Criminal Procedure);
B. The extraordinary investigating officers appointed by the mayor, as referred to in article 142, paragraph 1, sub a, of the Wetboek van Strafvordering (Code of Criminal Procedure);
C. The supervisors appointed by the mayor.
Article 6 Punishment
Violation of a provision of this Regulation will be punished by a detention of no more than three months or a fine of the second category in accordance with Article 443 Wetboek van Strafrecht (Criminal Code).
Article 7 Entry into force
This Regulation shall enter into force on Friday, June 30, from 06:00 pm until Sunday, July 2, 6:00 pm or expire at the time when the mayor has announced that the Emergency Ordinance has been lifted earlier.
Article 8 Short title
This Regulation is referred to as 'Emergency Ordinance Concert at Sea 2017'.
